POLICIES AND PROCEDURES

  1. A prospect shall be enrolled as a direct seller only upon the mandatory completion of a Viva Orientation Program (VOP), conducted via group or one-on-one meeting and explaining the entire compensation plan, details of the products, terms and conditions, all the clauses in Direct Seller Contract, other policies and procedures of IndusViva and the direct selling business model.
  2. No ID can be created on any partnership basis or in the name of a firm. However, an ID’s ownership may be transferred to a firm from the rank of Black Diamond Ambassador.
  3. Every business week begins on Saturday and ends on the following Friday. Revenues/Bonuses (earned in terms of money) during one business week will be credited into the bank account of the individual VBO on or before next Friday.
  4. Every direct seller must ensure the submission of their KYDS documents such as PAN Card, Aadhar Card, address proof, cancelled cheque by uploading clear soft copies immediately after their enrollment. Failure to comply with this before crossing the TDS exempted limit, will result in 20% of TDS and delay beyond a cycle will result in ID to go on “Sales Order Hold”.
  5. A direct seller shall initially enroll as a Viva Retailer (VR). The direct seller’s status shall be reclassified as a Viva Business Owner (VBO) upon achieving the requisite Star Rank or satisfying the other criteria set forth in the Compensation Plan.
  6. Ranks have to be achieved one after another; jumping ranks is not allowed.
  7. To become a VBO, the VR has to complete the process of submission of contract either by e-signature or uploading a soft copy of the application form along with the complete contract duly filled in and signed by self, the default co-applicant and sponsor, as witnesses, failing which the VBO status and incentives shall be withheld.
  8. The default co-applicant for a married VBO shall be their spouse. For unmarried VBOs, the default co-applicant shall be the father for females and the mother for males. In the event a default co-applicant is unavailable, and no other close relative is eligible; the VBO may elect to proceed without a co-applicant. All co-applicants must be adults of legal age.
  9. No husband or wife or their dependents are entitled to hold separate distributorships. Multiple IDs with the same name or in the name of spouse/relatives for which an existing direct seller is beneficiary, shall be considered as Dual ID. Dual/ multiple IDs will amount to termination of both/all the IDs.
  10. The distributorship is non-transferable; a Crown Black Diamond Ambassador ID may be sold as per the norms of the Transfer of Property Act, 1882, after obtaining a No Objection Certificate (NOC) from the company. The buyer of the ID can claim the revenue and benefits from the ID, not the status.
  11. VBOs are strictly prohibited from changing their sponsor and their line of senior associates subsequent to activation of the ID.
  12. If an ID is inactive for six consecutive months subsequent to activation, it shall be considered auto resigned and the access to such IDs shall be suspended. The direct seller may reinstate the ID or vacate it and the PAN can be retrieved by initiating a request from the registered mail ID.
  13. If an ID remains inactive even after 4 weeks from the week of contract and in the case of an ID remaining inactive for a period of 2 years subsequent to activation, it will be considered expired and removed from records permanently.
  14. A direct seller who holds an active ID or does not fall under the above-mentioned categories (sl. no. 12 and 13) can restart the business or engage in a fresh contract only after completion of 3 months (13 weeks) from resignation.
  15. A new VR can delete their own ID directly from the Virtual Office within 24 hours from creating the ID if no orders have been placed and no further IDs are created on either of their organizations in their genealogy.
  16. If an order has already been placed, a VR/VBO can still delete the ID within 3 hours of the first order placement. Upon deletion, the associated orders will be cancelled, and the amount will be refunded to the source account (the account/card/UPI from which the payment was made).
  17. The maximum order that can be placed in a day is restricted to 300 PV. Further orders can be placed on the following day, by doing so a direct seller confirms that as the previous order being completely liquidated.
  18. Courier charges will be on actuals for non-serviceable locations; including remote islands/ destinations/locations outside India.
  19. Products are issued or dispatched only after successful OTP verification. If verification is skipped at checkout, it must be completed subsequently to release the order. Mobile numbers cannot be changed after ordering. The company is not liable for delays caused by pending verification.
  20. The VR/VBO can cancel their own orders within 3 hours of order placement. Once cancelled, the refund will be processed to the source account. After the specified time frame, all the requests shall be considered as per the return and refund policy.
  21. A VR will have thirty (30) days of cooling-off period from the date of contract/enrolment. If a VR cancels his first order after the revenue statement is generated, minus PV shall be reflected on all concerned beneficiaries. Additionally, VBOs concerned are liable to settle the accounts with the company within 30 days if it hasn’t been set aside by that time.
  22. Trimming: If the sales and marketing cost exceeds 50% of the turnover of the company in any week, the excess amount will be equally deducted from all the beneficiaries of the particular week.
  23. For President's Club and Viva On The Move, the exclusive terms and conditions shall be applicable as per the respective agreement clauses.
  24. Direct sellers are strictly prohibited from selling products at prices below the established retail price. For all offline transactions, the direct seller must provide the customer with a formal, accurately completed Customer Receipt at the time of sale.
  25. Direct sellers are strictly prohibited from listing or selling products on third-party e-commerce platforms or any other online marketplaces without prior written authorization from the company. Should a direct seller wish to sell via their personal website or social media channels, they must ensure full compliance with the company’s Online Sale Policy.
  26. ID needs to be kept active as per the rank criteria in the compensation plan failing which the carry forward, if any, will be reset to 10,000 GV.
  27. Complimentary products will not carry any Point Value and shall not be included in the aggregated income. Sales are subject to audit. All complimentary products need to be claimed within 3 months of achievement. The reward shall expire thereafter and cannot be claimed.
  28. Berth IDs can be opened only after achieving the Black Diamond Ambassador rank.
  29. Reward programs are strictly for VBOs and default co-applicants. It is non-transferable and not eligible for carrying forward to subsequent events. Reward programs are available only for VBOs who are actively pursuing the business (earning DTR) until the commencement of the reward event.
  30. VBOs should follow the rank-wise responsibilities published by Vibrant Viva and support their associates from both/all the organisations until at least one each achieve Executive Diamond rank from the respective organisations.
  31. VBOs are required to maintain professional conduct at all times. They shall strictly refrain from engaging in any form of negative communication within their own team or with crossline members. Further, any attempt to solicit, influence, or encourage VBOs to engage in line-switching, including line-snatching, is strictly prohibited. Failure to comply with this provision will result in stringent action, including termination of the Direct Seller ID.
  32. Any form of aggression or behavior that compromises the dignity or modesty of any person, irrespective of gender, including misbehavior towards women, other direct sellers, customers, prospects, or the general public, is strictly prohibited. Misuse or unauthorized use of personal details of any direct seller, prospect, or customer for purposes other than those intended is also strictly prohibited. Any such violation will invite stringent action, including termination of the Direct Seller ID.
  33. VBOs are only allowed to use the product testimonials/reviews which are duly verified by the company. Otherwise, the company shall not be responsible if any dispute occurs due to the use of unauthorized testimonials/ reviews.
  34. Vibrant Viva is the only authorised education system who can publish training materials and marketing collaterals on behalf of IndusViva.
  35. System (Business Development Organisation) may only be created after achieving Crown Black Diamond Ambassador rank with the consent of IndusViva HealthSciences Private Limited; which will be considered as a parallel system to Vibrant Viva.
  36. Until achieving Crown Black Diamond Ambassador rank, only the team leader’s name or name of the city can be used by the Ruby Executives and above ranks. Ruby Executives and above ranks shall use their name for event promotions only in the absence of their senior associates during the event. The leader, whose name is mentioned in the promotions, should be present at the event.
  37. The team should not participate in any activities conflicting with the Vibrant Viva system.
  38. Creating personal/team logos and using it along with the Vibrant Viva system is strictly prohibited. Unachieved/conferred titles should not be used for any promotions.
  39. VBOs are not allowed to create any page/channel/accounts/online platforms in the name of IndusViva or Vibrant Viva or with the same prefix or suffix.
  40. Publishing content on social media or any other platform that is defaming/damaging to the company, products and fellow VBOs is prohibited.
  41. VBOs are not allowed to make and promote any marketing collaterals, accessories or anything of such kind.
  42. Any kind of promotions with monetary/ financial benefits or any aid to attract anyone to the business are strictly prohibited.
  43. VBOs shall not involve in any unfair trade practices such as false/overclaims, misleading information, hiding facts, false promises, etc. about products or business opportunities.
  44. Business opportunity of IndusViva is a part-time opportunity and if direct sellers decide to do it as full-time then they are liable to attend the training on Do’s and Don’ts of Multi-Level Marketing by Gulati Institute of Finance and Taxation, Trivandrum, Kerala or any other govt. institutes approved by the union govt. or any state govt. for the purpose.
  45. Association of a VBO with any other direct selling company will constitute a conflict of interest and is therefore not permitted. Further, association with any illegal activities, including ponzi schemes, money chain schemes, or similar activities of any nature, is strictly prohibited. Any violation of this policy will result in termination of the Direct Seller ID.
  46. VBOs wishing to join another direct selling or MLM company may do so only after formal resignation. VBOs shall not solicit or poach other VBOs by spreading negativity, false news, or through any other means of interference. Any such violation shall result in legal action, which may include the recovery of the entire payouts as per the contract.
  47. Violations of any of the company norms may attract discontinuation or cancellation of Co-applicant Revenue. The payment of Co-applicant Revenue will be at the sole discretion of the company.
  48. VBOs should comply with the laws, rules, and guidelines of the country and the respective states pertaining to direct selling.
  49. Any employee of IndusViva or their relatives are not permitted to enroll as the VBO of IndusViva.
  50. Violation of any of the above policies will lead to disciplinary action, which may even lead to termination.
